Terms and conditions of use

These terms govern the use of Exchards, the Android app and the exchards.com site. By using the service you accept them. If you don’t accept them, don’t use it: that’s the only consequence.
They are written to be understood. Where there is a limit that can cost you, the recognition gets it wrong, the price is only an indication, we say it plainly instead of tucking it away at the bottom.

In this text, “we” is the party above; “you” is whoever uses the service.
2. What Exchards is
Exchards is a tool that recognises your collectible cards from a photograph, matches them to the corresponding entry in the CardTrader catalogue, suggests a price based on the public offers of other sellers and, if you ask it to, publishes the listing on your CardTrader account, with your credential.
What Exchards is not, and it matters:
- It is not a shop. We don’t buy and we don’t sell cards. We don’t touch the money, we don’t handle shipping, we don’t take a commission on your sales.
- It is not CardTrader, and it is not affiliated with, sponsored by or endorsed by CardTrader. You are the one selling, on your account, under CardTrader’s terms. Anything about a sale, a payment, a shipment or a dispute with a buyer is between you and CardTrader.
- It is not an appraiser. The price it suggests is a market indication, not a professional valuation nor a guarantee of a sale.
3. What you need to use it
- To be at least 18 and able to enter into contracts. The service publishes offers for sale in your name: it is not an activity for minors.
- A CardTrader account of your own, in good standing under CardTrader’s terms, and its personal token.
- A verified email address. Without verification you cannot connect the CardTrader credential.
- Real information when you register.
The account is personal. You keep the credentials safe, and you are responsible for what happens through your account. If you suspect that someone has access to it, change your password and write to us.
4. Automatic recognition and its limits
This is the section to actually read.
Recognition is based on an artificial intelligence model that reads what is printed on the card, and on a catalogue match that follows fixed rules. In our tests the result is 93% on 103 cards, and 100% on cards you can tell apart from their face. It is not, and will not be, 100% in the real world.
- Some catalogue entries cannot be told apart by looking at the card: reprints and repackagings identical to the main set print. They get matched to the main print.
- Recognition by artwork suggests candidates, it doesn’t decide.
- Blurry or crooked photos, reflections, holos and damaged cards make the result worse.
- Prices come from the public offers on CardTrader at the moment you look, and they change.
The confirmation before publishing is yours, and it is your responsibility. The app shows you what it read on purpose. A listing published on your account is in your name, and you answer for it to CardTrader and to the buyer, even if the wrong detail was the one the app suggested. If you notice it afterwards, the listing can be edited or removed from the app.
5. How you must (and must not) use it
You may not:
- Use the service for unlawful activities, or to sell counterfeit or stolen cards, or cards you have no right to sell.
- Use someone else’s CardTrader credential without being authorised to.
- Try to get around the technical limits, the spending cap, authentication or rate limiting; probe or attack the infrastructure; use the app with automated tools that generate an abnormal load.
- Bulk-extract the catalogues, the archives or the prices in order to rebuild a competing service.
- Decompile or modify the app to use it in a way other than the one intended, except as the law mandatorily allows you.
- Submit images that infringe the rights or the privacy of other people.
You are responsible for the content you upload and the listings you publish.
6. Price, and why there is a cap
Exchards today is free. Every scan costs us some AI processing, and that’s why every account has a monthly cap: it’s a barrier against abuse, not a pricing plan, and it is set well above the usage of even a heavy seller. Once the cap is reached, recognition stops until the following month; the rest of the app keeps working.
If we introduce paid features in the future, they will be announced in advance and they won’t quietly turn what you are already using for free into something you pay for.
7. Service availability
We do our best to keep it standing, but we don’t promise continuity. The service depends on third parties (CardTrader, Google) that can change, limit or shut down their interfaces without asking our permission. There can be outages for maintenance, faults or causes outside our control.
We can modify, suspend or shut down the service, in whole or in part. If we shut it down, we give you at least 30 days’ notice, in time for you to take your data away.
8. Intellectual property
The app, the site, the code, the Exchards trademark, the logo, the archives we built and the texts are ours or our licensors’. We give you a personal, non-exclusive, non-transferable and revocable licence to use the app under these terms. Nothing else.
The photos you take stay yours. You only authorise us to process them in order to give you the service, recognising the card and showing you your history, as described in the privacy policy. We don’t use them for anything else, we don’t publish them, and we don’t train models on your images.
Pokémon and the names of the cards, sets and symbols are trademarks of Nintendo, Creatures Inc. and GAME FREAK inc. / The Pokémon Company. CardTrader and Google are trademarks of their respective owners. Exchards is not affiliated with any of them, and names them only to identify the cards and the services it works with.
9. Warranties and liability
The service is provided “as is”. We don’t guarantee that the recognition is correct, that the suggested prices are the right ones, that a card will sell, or that it will sell at that price.
To the extent permitted by law, we are not liable for:
- Lost profit, lost opportunities, or indirect damage.
- The consequences of a wrong listing that you confirmed (§4).
- Acts of CardTrader or Google: blocks, suspensions of your account, changes to or shutdowns of their interfaces.
- Misuse of your CardTrader token by anyone with access to your device or your account.
- Data loss caused by events outside our control.
Where liability cannot be excluded, it is limited to 100 euro or to what you have paid us in the previous 12 months, whichever is greater.
Nothing in these terms excludes or limits our liability for wilful misconduct or gross negligence, for death or personal injury, nor the mandatory rights that the law gives consumers. If a clause above conflicts with one of those rights, for you the right prevails, not the clause.
10. Suspension and closure
You can stop whenever you want: disconnect the CardTrader credential, clear the history and ask for your account to be deleted by writing to info@tiber-valley.com (see the privacy policy, §8). There are no penalties and there is no notice period.
We can suspend or close your account if you breach these terms, if you use the service for unlawful activities, or if your usage puts the infrastructure or the other users at risk. Except in an emergency or where the law requires otherwise, we tell you why and we give you a chance to reply. On closure, the data follows the privacy policy.
11. Changes to these terms
We can update them. If the change is substantial, meaning it changes your rights or our obligations, we tell you by email or inside the app at least 15 days in advance. If you don’t like it, you can close your account before it takes effect: that’s your way out, and it has no consequences. Carrying on using the service after that date counts as acceptance.
12. Applicable law and jurisdiction
Italian law applies.
If you use Exchards as a consumer, the court of the place where you reside or are domiciled remains competent, and the mandatory protections of the country where you live remain unaffected. You can also turn to the European online dispute resolution platform: consumer-redress.ec.europa.eu.
If you use Exchards in the course of a professional activity, the Court of Perugia has exclusive jurisdiction over disputes.
If a clause of these terms were void or ineffective, the others remain valid.
